Parents getting divorce - eviction clarification

23-Sep-2023 (In Divorce Law)
My mother (aged 65) wishes to get separated from my father (aged 68). She is threatening to get him out of the house saying she will evict him by serving him a divorce. The apartment was partly gifted by my grandad (moms dad) to my mom. Partly there was a lon taken by mom as she was working in the bank and could secure better int rates. My dad has paid for the running of the house and contributed in its upkeep etc. He is not claiming property right... but can my mom evict him from this apartment they have lived in for over 24 yrs. They have been married for 40 yrs.

It is very difficult but straight order cannot be paased unless domestic violence is established on your father. Further your father can file suit for permanent injunction and get stay order. Your father may also approach Asst Commissioner for getting protection order.
