On going Divorce / 498A case in different courts

08-May-2023 (In Divorce Law)

We have been living separately for more than 5 years, from pregnancy till today the father of the child has never come to meet the child and never attempted due to his parents. I have been seeing someone else lately and we have decided to marry each other, its already delayed and all these a stress to me cause of this. I need to know the pros/cons to this , please help me with them

you can file for divorce from you husband and claim maintenance for yourself and your child. You cannot perform another marriage till you are legally divorced from your husband. Such marriage will not be legally valid.
