How Many Days Should I Forward the Notice to the Respondent?

16-Apr-2023 (In Divorce Law)
On 07.01.2021, a legal notice for divorce was sent to my husband's residential address in Karnataka, Bellary. However, he has not received the notice yet. My lawyer says that the notice must reach the respondent as part of the divorce process.

I want to know how I can track the divorce notice to my husband, why it is getting delayed, and within how many days the notice should be forwarded to the respondent. For reference, we are Hindus and had a court marriage as well as a temple marriage in 2012.

Sending a divorce notice in India is a relatively quick process. Once a lawyer drafts the notice, it is usually dispatched within a few days via registered post, speed post, or courier. Delivery typically takes about 7 to 15 days, depending on the method used and the location of the recipient for instance, a courier to Karnataka might arrive in 7 days, while registered post could take closer to 15. While sending the notice itself is swift, the broader divorce process from notice to resolution can take several months to years, depending on whether it's a mutual consent or contested divorce.

Firstly, there is no mandatory legal requirement to send a legal notice for divorce. However, if you have already sent one, you can track its status online.

To check the delivery status, go to Google and search for post tracking. Enter the article number from your postal receipt to track the notice. If you have the registered postal receipt of the notice, you can share it for further assistance.

You can send a legal notice for divorce to your spouse through your advocate. Your advocate will retain a copy of the notice for future reference.

Once the notice is sent via post or courier, your advocate should provide you with the acknowledgment receipt. This receipt allows you to track the delivery status online. Typically, it takes around 7 days for the notice to reach Karnataka via courier and 15 days if sent by post.

Always send a Legal Notice through Registered Post with Acknowledgment (RPAD) or Speed Post. This allows you to easily track the delivery status of your notice, whether it is still in process or has already been delivered.

The acknowledgment receipt you receive for sending the notice serves as evidence in court.
