Null or void case filed along with Alimony settlement
19-Sep-2023 (In Divorce Law)
My husband has cheated with his health issue inspite it was asked directly to him before marriage and within 10 days of marriage i found him hiding tablets from me and when asked he confessed the truth, and within 1 month from my side case was filed asking for null or void since we dint have any physical relationship.
1. We have asked for alimony for marriage expenses and its been almost 1yr case is gng on but till date i have taking leave each and every month and attending the court hearings but my husband has come only once.
2. Exactly when courts asks him to attend they call my lawyer and tell that would come and speak reagrding the settlement but no one would call or respond.
Its like simply they keep dragging the case without no fault of mine my life is wasted and im mentally affected too..
Please some one help me is there anything i can do from my side addtional or how will the court proceed. Because they havent arranged for any councelling so far.
If the marriage itself is null and void then you cannot claim alimony which is entitled for a wife in a valid marriage and which is consummated. Compensation for marriage expenses is not alimony. I need more details to help you further.

Hi before furthering I need few details. In which court the proceedings are going on? When was the case filed? Are you/your counsel appearing regularly for all the hearings? Based on these inputs I can suggest you how the case could proceed.

if you are going for null and void and if the court granted that degree on basis of null and void no maintenance will be granted to the wife if it is mutual consent divorce then you can claim and permanent alimony but for the mutual consent divorce you must be separated for one year and after that you must also comply the condition that after the period of one year marriage only you can file the divorce petition and the cooling period is six months now it is waived to one month so null and void are divorce
