Desertion is valid ground for divorce but the period should be a minimum of two years. And if you are legally married and your partner is not coming then legally you can always serve him/her a legal notice and then after section 9 for calling back your partner into your matrimonial life. yes it will be considered null and void bcoz if this is not registered marriage but you can draft a Affidavit for future if she is claiming any amount on the other hand if u want to save this marriage u go both of you for register this marriage then it will be came in legal way will not consider null and void
