NRI Divorce ex wife is still in australia

My Ex wife and myself with 1 child went to Australia on student visa from Dubai in 2018, after reaching Australia my ex wife intentions is to get PR so she alleged DV and all sorts of issues on me , eventually my visa was cancelled and australia issued court orders, she now served me with divorce notice from australia while i have applied for exparte divorce how does this work as she is still an indian citizen.

The scenario provided by you here is sort of a grey area as far family disputes arise in a foreign land. Her stay in Australia and her visa status is upto your wife and the Australian government. You need to decide on how to proceed further with the divorce case that you filed. If the DV proceedings are pending in Australia then you need to contest the same to clear your name. Because it may have a bearing on future visa applications.

You can apply mutual consent divorce case in the family court and apply divorce papers and you can inform the issues to court . Now she can appear via Online also . So we can arrange the matters in court and get the divorce. Because she married another person or relationship with another person agreed and registered the marriage in Australia. So you can and she can also get divorce
