From a legal perspective, the husband has several avenues - filing for divorce on grounds of cruelty, seeking protection from harassment through restraining or injunction orders under relevant civil statutes, and claiming restitution of conjugal gifts and property where legally permissible. Additionally, threats and abusive conduct may also warrant filing a criminal complaint. It is advisable to immediately document all instances of threats, abusive communications, and property disputes, preserve evidence such as WhatsApp messages, emails, and witness statements, and formally respond through legal notices to assert the husband’s rights while protecting him from further harassment. In parallel, seeking interim relief from the family court to restrain the wife from making threats or demanding money can provide immediate protection and strengthen any subsequent petition for divorce or civil recovery of property. The approach should combine civil, matrimonial, and criminal remedies to ensure comprehensive legal protection. Additonally the wife’s refusal to provide documents necessary for the son’s visa application to Canada can be treated as obstruction in the lawful facilitation of the child’s travel and welfare, which may strengthen the legal position of the husband. Legally, both parents have rights and responsibilities regarding the child’s travel and documentation, especially if the child is a minor or dependent, and one parent cannot unilaterally withhold essential papers without lawful cause. Her refusal can be cited as part of economic and emotional cruelty, and also as interference with the son’s fundamental rights.

You have to file suit for restitution of conjugal rights to ask court to direct your wife to come to her matrimonial house. Or if you wish to proceed with divorce, you can do it under cruelty clause. If the child is minor, you can ask for custody as well.
