No mutual consent divorce between my brother and sis in law.

Married in nov and now it has been six months of the marriage.his wife has mentally tortured him during the 1.5 months They stayed together.they stayed witH our parents for one month also during that also his wife was always concerned with stupid things.ow My brother want to divorce her but she is not ready for mutual divirce.also once she said that she is pregnant and will test of same but she has not share the result.ow it has been 6 months and now My brother want a divorce.what all complications can We face?

It will be better if both the families can sit together and settle the issue between husband and wife. If wife is not ready for divorce on mutual consent then you have to collect strong proofs of mental harassment which could constitute cruelty, and which could be made as a ground for divorce. legal notice for divorce ground would be mental harassment torture etc however he shall give one chance to her and if no response comes or she is not interested further then consented divorce application can be filed. you may contact me

First of all you should be aware that according to the Provisions of Hindu Marriage Act no divorce petition can be file before the expiration of period of one year of completion of the marriage. your brother can file petition for divorce against his wife. after one year of marriage. Secondly there are certain grounds for divorce on which your brother can take divorce according to the Provisions of Hindu Marriage Act. your brother can file petition on the ground of cruelty but he has to prove the same by substantial evidence. you can contact me through the administrator of this website for proper legal advice and guidance
