No marriage certificate, separated for 4years

Hi we both Hindus got married in Gurudwara in a small get together. Separated now for 4years and more. No marriage certificate available, Gurudwara certificate we lost. Is there a need for divorce?

Hello It seems from your question that got married as per customary ceremonies at a Gurudwara. Validity of marriage and even ending the marriage do not depend on the certificate. there is a requirement of formal divorce to be conducted between the parties under the provisions of Hindu Marriage Act . once f formal divorce has been granted , the parties will be legally free to Marry other people .

marriage certificate is not required for a marriage to be valid. if you have been living separately for more than 4 yrs now, you may file for divorce. it's always better to go by the procedure in such cases so that later there is no complication.

Yes, It is a legal and valid marriage. Since your marriage still subsists you need to be legally divorced in case you wish to move ahead and go for a marriage again. You can go for a mutual consent divorce also if your spouse is also willing to be legally separated

Hi, as per the little information provided by you, it is advisable to follow the becessazlaw of land so as to not to get into trouble in the later phase of life. If bith are in consensus then it is advisable to file for a mitual divorce under Hindi Marriage Act.

In case of divorce there are other means to prove that you were married. You can produce your marriage photo, marriage card, etc to prove that you got married. The court does not require you to produce the certificate while filing divorce.
