No legal proof of marriage and husband is not accepting me as wife

21-Sep-2023 (In Divorce Law)
Good evening !! i am from Rajasthan and currently working in Dubai from last 6 years as a Business Consultant. My issue is that my husband is refusing me to accept as a wife now and i want to keep this relation. We got married in Feb 2016 in Mount Abu , Rajasthan in a temple without telling any of our family members. and i dont have any legal proof of my marriage except some pictures but those pictures are not taken inside the temple , it was taken outside but in those pictures i am wearing Sindoor as well as MANGALSUTRA. We both are Hindu. My husband is brought up in UAE but now he is living in india with his maternal grandparents in a village in gujarat. His parents and younger brother are in UAE and their financial condition here is very poor. also they do not have any home or land in India. I told about my marriage to my family in feb 2016 only and now i told everything to my in laws also but they are not ready to listen to me and meet me.

Is ur husband supporting u? If no than u can come to India and file a FIR against them as if they doesn't except u than thr is no proof that u r married with him and just with that pics u can just go to police station whr u got married in that state u can complain.

hindu marriage is not dependent of any proof it is soul to soul relations. next you have performed one of nine forms of hindu marriage .so you can claim your rights as per hindu marriage act like others. third you can file any litigatoon against husband or in laws in india only n for marriage proof you can file affidavit in lieu of it. so you can go ahead . domestic violence case can b filed from place of choice of u .rest dependents up on facts . so feel free for any more advise on subject in hand

This is not compulsory to registered a marriage under Hindu marriage act.
It has been proved by party who claim that marriage has been solemnised.
You didn't mention that what you want to do with your husband.
You want to live with him or not, if not then you can file a petition for dissolution of marriage and if you want to live with him then also you can file a petition for restitution of conjugal rights.

Hi, Please not that if you have entered into marriage he cannot deny the marriage moreover you have photographs so that can be good proof irrespective of the inside the temple or outside the temple. You can initiate legal proceeding by sending notice to perform matrimonial obligation and then after if not successes then you can approach the Hon'bl e court by way of RCR restitution of Conjugal right. Detail consultancy can only be provided after knowing the entire facts of the case.

Dear Medam
First of all you made a mistake that you have not informed any one and married in one temple. You ask for prist ( Pujari) for giving witness for marriage. Second one informe your husband to accept the relation between you. If he denies file FIR against him for Rape and provide copy of photograph to the police. Please do not provide original photographs to the police.

Thanks.
