She Throw me out over past misunderstandings in April 2017 from her residence. Now she is sending threats for Mutual Divorce or She Will File 498 DV Dowery Cases and Put me In a Jail. We did Intercast Love Marriage in 2005. Baby Girl Born in 2011. I am homeless and living on mercy of friends... May I get Maintaince till she files a Petition. ?? Pls Help
Advocate Rajiv Rajpurohit answered
Hi, Please note that the if you have not taken dowry or demanded then there is no need to be worried moreover 498 A is where the merit and cruelty needs to be proved. Prima facia it seems that that she is working and govt servant moreover you have been taking care of your daughter therefore the there are less chances of the getting maintenance. As far as mutual consent decisions it should be independent decision since question involved basically about the custody and alimony . therefore it should decided by the parties before coming to court.
