Q: Parents are having government job

Hello ,Need advice that my parents after my marriage misbehaved with my wife and due to miss matched understanding we are shaving daily dispute so we stop talking to then get separated. Now have treaten case against me to not taking care for us . Father age is 58 and mother is 48. Please give advise on this.He is going to retire this diwali. Father is government teacher and mother is house wife.

If your father is earning and having source of income then he cannot claim maintenance from you as well as your mother is the responsibility of your father therefore question does not arise is that he can claim any kind of maintenance or he can sue you

you can demand maintence from your husband, it depend on the court to decide whether you are entitled or not but certainly you can knock the door of the court for remedy. Maintance case if filed court may grant as per life style u enjoyed

Q: Procedure to claim maintenance from wife

My wife Working As A Civil Judge in Trial Court.. I was taking care of our Daughter and Her since Her Job Started in 2012. She Throw me out over past misunderstandings in April 2017 from her residence. Now she is sending threats for Mutual Divorce or She Will File 498 DV Dowery Cases and Put me In a Jail. We did Intercast Love Marriage in 2005. Baby Girl Born in 2011. I am homeless and living on mercy of friends... May I get Maintaince till she files a Petition. ?? Pls Help

Hi, Please note that the if you have not taken dowry or demanded then there is no need to be worried moreover 498 A is where the merit and cruelty needs to be proved. Prima facia it seems that that she is working and govt servant moreover you have been taking care of your daughter therefore the there are less chances of the getting maintenance. As far as mutual consent decisions it should be independent decision since question involved basically about the custody and alimony . therefore it should decided by the parties before coming to court.

Passport size photographs, address proof of both, birth certificate or school leaving certificate, witness and their ID proofs. Procedure marriage needs to be performed in presence of priest and thereafter registrar after verifying documents will registered your marriage.

Q: Procedure and limitation to file for custody of daughter from husband

I file 125 & domestic violence case in court only. I didn't file any case in police station.. For last 2 times I m getting next date only. My 6 year old daughter is with him from last 6 month. He don't allowed to meet her. I have doubts he wash her mind too. I want to meet my daughter.. Any advice for it pls..? When I can file her custody case..? I mention about my daughter in domestic case. My lawyer is advice me to wait till domestic case date answer.. What step should I take..? Ur advice may help me a lot...

You can file interim application in your DV case itself for visitation and custody. You can file custody case anytime before the Hon'ble court under Guardian and ward act. It is advisable you should try in your DV application itself.
