Next process after bail at police station in false 498a

15-May-2024 (In Divorce Law)
A false 498a is registered against me and my family. Anticipatory bail procedure has been completed at the police station. On the day of bail at police station we were given a letter by the IO stating that the chragesheet will be sent to court and our presence with witnesses is required at court after 4 days. We received another letter from IO after 3 months of the bail stating the same thing. The court official has chargesheet but said case will be registered only when we come with witnesses.

In the light of a judgment , In cases of 498A , an inquiry is made before the case is registered as it is also the matter of reputation of the family. We need to show that it is a false allegation. Both the parties will be heard. For further guidance need to know some more details.

This information seems false. As once chargesheet is filed, then case has to be registered by court. Either there is some miscommunication between you and IO. or the IO has given you wrong info. Also, you are accused, you are not required to get your witnesses examined at this early stage of court proceedings. It is the complainant who has to prove her case, through her witnesses. You must get an advocate in the case for defending you.

Well, if the Police is doing delay to file the Chargesheet, then, you can file a Complaint in this regard to the concerned trial Court where your case is going on. Make sure you mention all the minute details in the Complaint and it should be in writing.
