Need to take back Mediation Amount

02-Apr-2026 (In Divorce Law)
I've had a mediation scheduled with my in June 2025 at Allahabad High Court. INR 35K was deposited to Mediation Center. Wife didn't come, her absence recorded, mediation failed. 5K was the mediation fee, 30k supposed to be returned. Please tell me If I can get the amount back: 1. Can I get it on my own? 2. If Yes, what would be the procedure and in how many days it will be settled? 3. If Not, can you do it? Please mention your fee and time and other requirements.

Yes, you can apply for refund of the unutilized mediation amount. In your case, since the mediation has failed due to non-appearance of the opposite party and the same has been officially recorded by the Mediation Centre of Allahabad High Court, you are entitled to seek refund of the balance amount (₹30,000), after deduction of the mediation fee. Can you get it on your own? Yes, you can personally apply for the refund. There is no legal compulsion to engage an advocate for this specific step. Procedure: You need to file a simple application before the Mediation Centre/concerned authority of Allahabad High Court mentioning: Case details Date of mediation Deposit receipt details Ground that mediation failed and amount is refundable Attach: Copy of deposit receipt Copy of mediation failure report/order ID proof and bank details (for refund processing) Time frame: Usually, the refund process may take around 2–6 weeks depending on administrative processing by the Mediation Centre. If you prefer through advocate: An advocate can assist in drafting and filing the application properly and follow up with the registry to expedite the process. Overall, the amount is refundable and the process is procedural, not complicated.

I am Adv. Sudesh. Regarding your query, yes, you are entitled to a refund of the ₹30,000 balance since the mediation failed due to the other party's absence. This typically requires filing a formal application and a copy of the mediation report before the concerned office at the Allahabad High Court. I can certainly assist you in handling the documentation and legal process to ensure the refund is settled efficiently. For a detailed discussion regarding the exact timeline, my professional fees, and the next steps, I recommend scheduling a consultation with me. I look forward to assisting you.
