Need to file divorce and alimony

17-Aug-2023 (In Divorce Law)
I’m from Sikh family. This is my 2nd marriage but seems like unsuccessful marriage. I have one daughter from my 1st marriage and I’m taking all her responsibilities including financial and mental. I’m taking care of my responsibilities as well. My husband is not taking any responsibility like mine, my daughter’s any any financial need. I want to divorce him and want to file for Alimony as well. Please suggest how I can proceed further. Currently, we are living together but he is in ground floor and I lives in first floor. Can I file divorce now, while staying together however on different floor?

The Judiciary is a system of courts which interpret and apply the law. ... The Supreme Court, also known as the Apex Court, is the top court and the last appellate court in India, and the Chief Justice of India is its top authority.

Yes you can file for divorce if your husband has abandoned you for your maintenance. Also if you are not working then he is absolutely liable to maintain you and your child. On the ground of cruelty we can proceed to file for divorce. Please feel free to contact for any further legal assistance Thanks

Dear client, You can definitely file for divorce by staying together with husband and also you should not leave your matrimonial house. Alimony from husband depends on what is your status and your husband standard of living and job profile etc. you can ask maintenance for your child as-well. Please consult further to get details.
