Mutual Consent Divorce is the most time-efficient and less adversarial mode of dissolution of marriage recognised under Section 13-B of the Hindu Marriage Act (or the corresponding provision applicable to your personal law). Both spouses must be in complete agreement regarding (i) termination of the marriage, (ii) permanent custody/visitation of children, (iii) return of articles/stridhan, and (iv) financial settlement, if any. The process involves two motions before the Family Court: 1. First Motion – filing a joint petition affirming that the marriage has irretrievably broken down and both parties no longer wish to continue the marital relationship; 2. Second Motion – after the statutory cooling-off period, confirming consent. Upon satisfaction of the Court, the marriage is legally dissolved. The professional charges for a Mutual Consent Divorce vary depending upon jurisdiction, complexity of settlement terms, and drafting/appearance requirements. These are determined on case-specific factors after understanding your documents and the reliefs you seek. Once you are ready to proceed, we will guide you with the required documentation and initiate the process before the competent Family Court.
