Need Legal Help for Domestic Violence Case Filed at Tis Hazari Court

20-Jul-2025 (In Divorce Law)
Hello, I am looking for legal advice and representation regarding a Domestic Violence complaint that has been filed at Tis Hazari Court, Delhi by my brother-in-law’s wife. Although my name and my wife’s name are mentioned in the complaint, we live separately in Greater Noida and have had no involvement in the dispute. We have not received any direct summons yet. We need a trusted lawyer in Delhi who can: • Review the complaint and advise if any action is required.

Thank you for your query. Since you and your wife are named in a domestic violence complaint despite living separately and having no involvement, it is important to file a detailed representation or application for discharge/quashing at the appropriate stage. First, the complete complaint needs to be examined to assess the allegations and whether your names are unnecessarily included. It’s also crucial to prepare for any potential summons. I am based in Delhi and can assist in reviewing the complaint and advising you on the next legal steps, including anticipatory action if needed.

Since your and your wife's names are mentioned in the Domestic Violence complaint, it’s important to assess the allegations carefully even if you live separately and have had no involvement. Please share a scanned copy of the complaint or let us know if you’d like us to help obtain it from the court registry. Once reviewed, I’ll guide you on the best course of action.

If you haven't received any summons from the court then you are not duty bound to attend the court proceedings. And as far as your names are concerned in the complaint it can also be removed if you are not directly involved in the current matter.

till you don't recieved summon you have not to appear before magistrate...if court thinks that their is no direct involvement of any person court didn't send summon to them... and after receiving summon also you have chances of discharge by putting your evidence/arguments...it's good if you have copy of complain filled by brother in law's wife..contact us for free legal advice
