Need help to Expedite DV and 498A case

03-Sep-2025 (In Divorce Law)
Even after high court direction to expedite 498A case, there has been no progress in one year except accepting that the charge can be framed. The order sheet was supposed to prepared but judge did not sign the same for about 2 months and just getting next date. I asked for time bound petition but it dint happen. In DV also I requested and got to know that there has been no sign of judge from one year. Something is wrong definitely. Can we ask to time bound for an year by Supreme court?

You can file for expedite 498a again in the High Court. In the DV act , you can also file for expedite. The High Court can give directions for time bound but it is on the case merit. provide me the date of F.I.R and its present status date of application of DV act and its status then I can help you.

sir as per your given information I found that you have one direction under Section 498 capital A which you want to dispose one year but court and system judicial system does not support you so this stage you can file a contempt of court contempt of court against second thing is that you can file a direction for Speed disposal under section 12 Bob DB act because section 12 subsection 5 find that a domestic violence case must be decide within 60 days or within 2 month so you can file a direction for the same the code not decide within given duration art act in any expedite duration you can file a content of code against that magistrate or PO final

Yes, you can ask the Supreme Court to make your trial time-bound for one year. But as a first step, it is more practical to move a contempt petition in the High Court for non-compliance of its earlier directions. If that also fails, then approach the Supreme Court under Article 136. Approach High Court Again • Since the High Court had already given directions to expedite, but the trial court is not complying, you can file a contempt petition in the High Court under Article 215 of the Constitution (contempt of High Court’s order). • High Court can then call for an explanation from the trial judge and issue strict directions for compliance Petition Before Supreme Court • You may file a Special Leave Petition (SLP) under Article 136 of the Constitution before the Supreme Court. • Supreme Court has the power to direct time-bound disposal of criminal trials (including 498A and DV matters). • In past cases, the Supreme Court has given strict timelines (e.g., within 6 months or 1 year) for trial completion when inordinate delay is caused. ⸻ 3. Administrative Remedy

No, you don’t need to approach supreme court, its is better to file a contempt case in the hight court only. Moving to Supreme Court will only be tedious for you. You can contact me for more details, regarding your further course of action
