Need help for seeking Divorce from husband as he is refusing to agree
15-Oct-2023 (In Divorce Law)
Hi,
I have been married for 1 and a half year now and the marriage is solemnised under Special marriage act 1954.
My husband has been staying abroad since the beginning, all in all we have stayed together for 2 months in total and I have realised that I don't want to be married to him. Our personalities are not at all compatible and I have developed interest elsewhere with someone else.
What are my options to get a divorce from him if he's adamant on not giving it. Also, if I go unilaterally what counter cases can be put on me...am I liable to any compensation that I have to give him to be seeking divorce?
Please help.
No under the special marriage act under section 27 it id is the husband who has to pay permanent alimony, further if he is not agreeing for divorce by mutual consent you have to file a petition against him asking the court to grant divorce on ground of CRUELTY, and the husband at the most can file a case of restitution of conjugal rights under section 22, you can also file Petition for maintenance and divorce against him, unless you file it is not going to end hence take steps and first file the case if you want to end the relationship legally.
