Sir As per your opinion you can file divorce petition before the concerned court on cruelty ground and also you can obtain anticipatory bail if you are afraid of arrest in a dowry harassment case. for any legal assistance feel free to contact me. K.Shashikumar Advocate Bangalore

You can file a divorce petition on grounds of mental cruelty and harassed from the wife. on these grounds we can file a divorce petition. In case she files a 498a case against you then you can file quashing petition in high court.

Legal Notice Consider sending a formal legal notice for restitution of conjugal rights or expressing the intent for a mutual contested divorce. Evidence Preservation Save all electronic communications where threats are mentioned. Mediation In many jurisdictions, courts refer matters to mediation first to explore the possibility of a Mutual Consent Divorce, which is less adversarial.

If the marriage cannot continue, first collect all proof (messages, call records, medical records, incidents of cruelty/desertion). Then file a divorce petition in the Family Court on valid legal grounds such as cruelty, desertion, or mutual consent. Try mutual divorce first if possible, as it is faster and less stressful. Also be prepared for issues of maintenance, child custody, and interim applications from the other side.

Hey, hope you are doing well. Based on what you’ve shared, threats of filing false dowry or harassment cases and continued mental pressure can amount to mental cruelty under law, and you may consider initiating divorce proceedings on that ground; at the same time, ensure you preserve all communications and evidence of such threats, avoid any confrontational exchanges, and be prepared to take immediate legal steps including anticipatory bail in case any complaint is filed.
