Need guidance in divorce case and defenses against dvc and 498a
08-Sep-2026 (In Divorce Law)
My wife filed 498 and dvc cases on me on different courts after i filed for the divorce under the grounds of cruelty and dessertion. She filed interim maintenance in divorce case and maintenance in dvc case, 498 proceedings yet to start. Currently I get it referred to mediation in divorce case.
Kindly guide me how to proceed if mediation fails, and how can settle this matter without maintenance granted.
Ps- I don't have children in the marriage.
If mediation fails, the divorce proceedings will continue before the concerned court, and you should file a proper counter/reply to the wife’s claims and contest the allegations with supporting evidence. The maintenance applications in the divorce and DVC proceedings must be addressed separately; maintenance is not automatically avoidable merely because you have filed for divorce, and the outcome depends on the applicable personal law, both parties’ income, conduct and other circumstances. Since there are no children, the child-maintenance issue does not arise.
For an amicable settlement, you can negotiate a full and final settlement covering divorce, maintenance/alimony and withdrawal/closure of pending proceedings, and have the terms properly recorded before the competent court/mediation centre. Do not make informal payments or sign any settlement without legal scrutiny. Please visit the office for further assistance and to examine the pending cases and settlement options.
If mediation fails, the divorce proceedings will continue on the pleaded grounds of cruelty and desertion, and the pending 498A/DV proceedings must be contested separately on their own merits. There is no automatic bar on maintenance merely because you filed for divorce, but her entitlement depends on the applicable law, her income, your respective financial circumstances, and other relevant facts.
For settlement, you can negotiate a comprehensive mutual settlement covering divorce, maintenance/alimony, 498A, DVC and all other pending disputes, with appropriate withdrawal/closure terms and no further claims. Do not agree to any payment or settlement without ensuring that the terms provide complete and final resolution of all proceedings.

Namaste
You filed for divorce first. The 498A and DV cases came afterwards. Put this chronology on record by mentioning the petition date, FIR date and DV application date in every proceeding.
If mediation fails, nothing is lost. The petition will return to the regular board and proceed on merits. You must then prove cruelty and desertion by evidence. For desertion, you must establish continuous separation for two years before filing and her intention to permanently abandon the marriage.
Regarding maintenance, courts rarely grant nil maintenance, but the amount of maintenance can be contested. Under Rajnesh v Neha 2021, both parties are required to file an affidavit of assets and income, and parallel claims must be disclosed. Maintenance in the DV case and interim maintenance under Section 24 of the Hindu Marriage Act cannot result in double payment. The court must adjust one amount against the other. File an application raising this issue in whichever case is heard later. Place on record her qualifications, work history and any income. If there are no children, the amount will depend primarily on her personal needs and your net take home income.
Regarding 498A, for offences committed after 1 July 2024, the relevant provisions are Sections 85 and 86 of the Bharatiya Nyaya Sanhita. If the FIR is vague or names relatives without assigning specific roles, examine the possibility of filing a quash petition based on applicable legal precedents.
For a complete settlement, the parties may consider a package settlement involving mutual consent divorce under Section 13B of the Hindu Marriage Act, a one time lump sum towards full and final settlement of all maintenance and stridhan claims, withdrawal of the DV case and appropriate proceedings for quashing the 498A case. Any payment should be made only against simultaneous compliance with the settlement terms and not substantially in advance.
Immediate steps include filing your Rajnesh affidavit, opposing interim maintenance on the ground of overlapping or double claims, considering clubbing or transfer of the matters where legally permissible and seeking early disposal of the proceedings.
To advise precisely, I would need the dates of marriage and separation, her employment status, your net income and the present stage of the DV and 498A cases.
Hello Sir, I understand your situation. Since your wife has initiated DV and 498A proceedings after you filed for divorce, and maintenance is also being claimed in different proceedings, the matter needs to be handled carefully and with a proper overall strategy. Since the divorce case is now referred to mediation, you can explore a full and final settlement covering the divorce, alimony, withdrawal of the DV and criminal proceedings, and any future claims. If mediation fails, the maintenance claims and other proceedings can be contested on their merits, and the fact that maintenance is claimed in multiple proceedings can also be brought to the Court's notice for appropriate adjustment. Whether maintenance can be avoided or reduced depends on the facts, income, employment and financial circumstances of both parties.
Please share the case details and copies of the divorce petition, DV complaint, 498A FIR and maintenance case after reviewing them, I can advise you on the best strategy for mediation and, if it fails, how to proceed with each case.
