In this case you have to first obtain a e divorce then get married, if you marry without obtaining divorce the second marriage will be illegal and invalid, hence first file a case for divorce and after obtaining divorce then get married.

No, you cannot marry without getting divorce with your first husband. If he is in abroad it is easy to get divorce ex parete since he may not contest the divorce petition which you may file. For more suggestions contact me in person....

Ans: if there was no marriage as per law and not registered then there may be no hindrance to get married, a living in relationship is not considered as marriage.
if there is a marriage, definitely you need to take a divorce from the court which is the only solution before marriage.

Did you marry at Sub-Registrar office or in any temple. Is there any documentary proof for that marriage for example: Photos, video recording or any registration done at Sub-Registrar office. If yours is a registered marriage then you have to get divorce to marry again with some one else, for this you and your partner can seek mutual consent divorce before Family court through the help of a lawyer. If your marriage has taken place in any temple or anywhere in front of your friends or well wishers if that event is photographed or recorded and if you think your partner is troublesome for your future life then also it is better to take divorce or destroy that evidences by taking from if he posses the same. If not under above said circumstances then you can marry without any legal hassals . Mean while don't repent for the past just make your future beautiful and promising listen to your parents.

Please do not marry second time without dissolving your first marriage before the family court. There is every chance of making a complaint against under Section 494 of IPC for the offence of Bigamy. So i suggest you to first dissolve your first marriage.
