My wife put maintenance case and put sec 9 on me

30-Jul-2023 (In Divorce Law)
My wife left 2 years ago. She put sec9. I filed Sec13 1ia. Failed counselling at mediation center. She wantedly filed 125crpc. Next hearing on Nov. How to counter maintenance case? I do not want to give money. Once she is working in MNC company, now she was not working.

You just need to collect evidence of her current or previous employment and draft a strong reply/WS against the maintenance case filed by her. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Hi. All the documents and facts of your case will have to be analysed before it can be determined how to defend the Section 125CrPC application that has been filed by your wife. Kindly contact me for consultation.

For Defending Sec 125 Crpc, you have defences like the wife is living in adultery, or if, without any sufficient reason, she refuses to live with her husband, or if they are living separately by mutual consent. You need to prove any of these conditions to deny maintenance to her.
