My wife not allowing My minor daughter to come to me

I have a 5 years old daughter my wife इस mentally not fit she quarrel with me since our marriage after birth of my daughter she started to emotionally torture me and dont allow my daughter to talk to me and come to me since its birth now she is 5.4 years and she always says she is only my daughter and dont even touch me daughter nCan I take my daughter away from her and file a divorce case in other city so that I can upbring my daughter
If the behaviour of your wife is intolerable towards you and there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. you can file child custody case, as you mention your wife mentaly not fit so you have chances to get custody of child through court.. but case will be file in jurisdiction where child lives... you can also files divorce case
