My wife filed a Mutual consent divorce

Hi sir/madam, We are Christians. my wife already lodged a MC divorce and pending, -she's in Bengaluru with My 2 kids and I am on Melbourne now. -What do I do now, what happens to my kids, if we agree for Mutual consent divorce, -so later should I stay in Bengaluru to have access with my kids or can I go back to melbourne for work and visit every year. -I have already being paying the full maintanace cost every month -Also what happens to my savings and my property later - Do I need to give her my 50% of all my assets, (what all I need to pay her) Thank in advance. okay I don't nderstand your qurey already your wife filed contesed divorce write so now you are staing out if banglore so you do one think sir do you want your wife and kid you will file RCR case if you don't won't your wife you will ho and settled mater and close it case and if you want your kid you will FilebG a nd W C case a nd take permanent custody and you don't want kid you will give to you r wife care of children if you need any further legal help contact me thank you

If both of you agree for divorce by mutual consent, you can file a joint Petition. The terms and conditions are upto both of you but it's best to discuss these (1) custody and visitation. You can share custody or give your wife custody, but set down proper conditions retarding their education, upbringing, and restrict adoption/change of name if she remarries. You can seek visitation rights, phone calls, video calls etc. If you agree to let the children reside with her, you don't need to stay in bangalore. (2) joint property/ assets - if you own anything together, please close the transactions. For eg if you have joint property, then release your share or have her release her share. otherwise you could face problems in the future. (3) you don't need to give 50% of your assets if you decide all of the above.

At the moment, so cases are being conducted through video conference/ virtual courts. You may need to sign the paperwork and send it to India though for filing.

Dear Sir,
Better execute a Special Power of Attorney in favour of your relative or friend who is residing in Bengaluru to contest all the cases filed by your wife. It may be settled in compromise before mediation centre if you can pay some reasonable one time settlement amount.
