hello your sister can file contested divorce u/s 13(1) of Hindu marriage act before the family court and to support her cause for divorce she can also file complaint under domestic violence act before the area judicial magistrate or file complaint in women police station for the cruelty she suffered if any. However best solution is to resolve matrimonial dispute mutually among family members, family members and friends of both tge side can sit together and resolve the issue

She can file a divorce without his consent. If she would like to do it mutually, your sister can go for mediation. Although a mutual consent divorce is easier, it is still possible to have a contested divorce. The law is more favorable to the woman in cases like this.

Hello if there are legal remedies available in the Hindu Marriage Act. If there is no incident of demand of dowry you need not file complaint regarding 498a. Your sister can file a contested divorce case under section 13(1) Hindu Marriage Act in the court on the valid grounds, therefore in this case consent of her husband is not required to file divorce case.
