My marriage was never registered

22-Sep-2023 (In Divorce Law)
Can we get an affidavit made that we will not interfere in each other's lives in any way and are free to get married to others since the marriage was never registered. Do I need a divorce. I have the church certificate.

Even if you do not possess the registered marriage certificate it does not make any difference when there Is Church certificate to prove marriage being solemnised. Mere affidavit won't suffice. its better you obtain divorce decree from court. There are different ways to obtain it. We can discuss them once your complete query and requirement is known.

If you are married, then if you want to get separated from your spouse, you have to mandatorily file for divorce. Without divorce, your second marriage will be illegal. If both of you are willing to get separated, you both can file for divorce by mutual consent which will be done in six months. Marriage registration is a different thing, even if it is not registered, you have to get separated only by way of divorce. For further assistance, you can contact me.

if you have the church certificate as to marriage then you are married in the eyes of your community you have to file for divorce in the court of your jurisdiction . the court will pass and order if you both want to be separated then opt for mutual divorce it is less time consuming

No, you have to legally seek a Divorce. Otherwise, your Spouse may create an issue tomorrow, that, you guys had not taken legal divorce and as such, you cannot marry with someone else and can tomorrow claim rights on your Property being your lawfully wedded Hubby.
