You need to hire an expert advocate in this regard. Giving consent that you are living separately for more than two years itself is close to the ground of desertion ! Kindly b in touch to understand the legalities Thanks

Making false statements in a petition to the Court is a crime. I would advise against it. For filing a petition of Divorce through mutual consent, one year of living seperately is required however under certain circumstances this one year period can be waived off. you can contact me incase of further queries.

Dear client Out of court divorce has no binding. You will have to approach the family courts for a mutual divorce. Wherein your mutually agreed settlement will have to be filed. Feel free to get in touch to discuss further.

It is the wife of the husband who has to decide on giving a divorce to the husband or not. The wife can give her consent to file a mutual divorce petition before the competent court of jurisdiction. If the wife does not wish to give her consent for a mutual divorce then they can move for a contested divorce. Before filing a mutual divorce petition do confirm that you are receiving benefits from the consent.
