Dear Queriest, You can get alimony on the grounds where you and your daughter have no source of income and also you can ask for the property against in the name of your daughter, but there should be such grounds to show that your husband is by himself wanting to get divorce from you. And he wishes to discontinue the said matrimonial relationship.

1. shall i get monlthly alimany from husband
Answer: Yes you can get monthly alimony;

2. my daughters are too small elder one is 9 years old and younger one is 3 years, so what about my daughters custody
Answer: File a custody application along with the divorce petition and make arguments for the same;

3. if I get custody of my daughters, then what about their education expenses
Answer: You can ask the same from your husband. You should also be equipped to manage the expenses of the child if you want the sole custody otherwise go for joint custody;

4. we have flat at where me and my daughters are live now, shall I get that flat
Answer: Yes (if father is owner of flat) you can get 50% of the flat in your favour and rest 50% will be husband's name. If the flat is in your name then you are 100% owner of it.

You and your daughter can get monthly alimony.and you and your daughter's can stay in flat where you are staying now.Custody of child is depend upon religion of you.If you are Hindu Custody of child shall be with natural mother upto 7 years and thereafter natural father has right of custody of children. But custody can be determined by court taking into consideration welfare of children.
