My husband is not co-habiting with me & my child and not providing us.

Its 9+ yrs of arrg mrg & also hv 8yr old kid. My hsbnd stopped co-habiting wid us. Thou, I'm living in my marital joint famly house but they hv kept me on separate floor. He is not taking any financial/physicl/emotionl responsibilty of us since long except paying kid's school fee (2.5k pm) Rest I have to tk care wid my little income & effrts. Now he demanding money for bijli bill & houserent. He is mentaly tortring me as his parents dnt like me and want him to stay seprate.I wnt to tk my rights.

you can file domestic Violence & maintenance for yourself &your children, you will get financial & residential protection from the court in same house,you will also get protection from any form of torture.

Hello,
I recommend filing for S125 maintenance to cover your and your child’s monthly expenses, as well as filing for divorce on the grounds of cruelty. You may also want to seek custody of your child. May I ask where you are from?

You can approach the Court and avail the remedy of maintenance, living accommodation, etc. from your Husband, but you need to file appropriate Application before the Court and the Court after consideration on the issue may give you the benefit as prayed for. If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Would advise you to seek a detailed legal consultation from an Advocate for your marital discord. As you have mentioned that your in laws are torturing you and your husband is not taking any responsibility and living separately it tantamount to domestic violence for which You can initiate a case under the DV Act. Further maintenance petition can also be filed.
