you first need to understand that without evidence you cannot prove your point and proper recording of few incidents are very much required more over you must not file for divorce or run away because you have a high chance of acquiring tje house and alimony for yourself and your child's security in the near future so proper planning is necessary to go ahead

As per your query in law rato yes you can file a case against your husband and ask for maintenance and also if you are not willing to stay with your husband then file a divorce case and also you can ask for child custodian from your husband.

in any case it is important to collect and gather evidence to prove your case before a court of law. you can complain to the police and under protection officer under Domestic violence act depending on the kind of solution that you are looking forward to. running away is suggested if your husband is likely to cause or inflict serious harm on you if you stay with him. divorce is your prerogative and right and with great respect would suggest exploring the option if you think you want to take it. other than that you will be eligible for maintenance for you and your child.
