My father died. She will get property share?

02-Jul-2024 (In Divorce Law)
My wife filed sec9 and I filed sec13 1ia. Court counseling failed. No kids. She was working women before our separation. I have private job. No properties on my name. My father and mother had properties. Recently my father died. Now my wife will get a share on my father property. The property still not changed to my name. How to avoid to not get that property to her?

Hi, she can claim maintenance and permanently based on your salary and your other means of earning . It all depends on the nature of the property what your mother is having. If your father purchase that property on his own then after him if he has died without making any WILL then property will inherit to you and your mother and other siblings if you have. Only thing you can do you can relinquish share right to your mother.

it seems you are the only son to your father. Your mother must be alive and you can transfer the Khatha to her name. if you do not have a Child or Children they get rights burt not your wife, if you are not earning your wife can only claim maintenance.
