My ex-wife is a Danish citizen, and I am an Indian citizen. We obtained a mutual-consent divorce in Denmark in 2023. Is recognition of the decree still required in India? Please respond over email as i am not 100% reachable by phone.

Although that post order was obtained in a foreign court, to have the same validated in India, we have to file a declaration, suit and family court seeking enforcement of foreign judgement. May take approximately six months to 1 year.

Since your marriage was dissolved by a mutual-consent decree passed by a competent court in Denmark, the decree may generally be recognised in India, provided it satisfies the requirements under Section 13 of the Code of Civil Procedure, 1908, and is not opposed to Indian law or public policy. Mutual-consent foreign divorce decrees are usually recognised by Indian courts when both parties voluntarily participated in the proceedings and consented to the divorce. However, recognition may become relevant if you intend to remarry in India, update official records, deal with property matters, or if any authority specifically requires proof of the decree's validity. A review of the Danish divorce decree and related documents would be necessary to provide a definitive opinion on its enforceability and recognition in India.

Generally, if your divorce in Denmark was granted by mutual consent and both parties voluntarily participated, a separate recognition process in India is usually not required. That said, the exact position can depend on factors such as how the marriage was originally registered and the terms of the Danish decree. If you intend to rely on the decree in India (for example, for remarriage or official records), it may be worth having the documents reviewed by an Indian family-law lawyer.
