My daughter custody who is with me after birth husband not visited onc

My husband throw me out of house when I was pregnant and told baby will handicapped...and filled section 9 ..after my daughter birth he didn't come to see baby. then later I filled DV and 498A.,. now he is black mailling me over phone call that he Will take child custody and kill my daughter didn't record phone call as got call from another no .. kindly suggest me how I should stop this.now my daughter is 3 year and he was not paid any maintenance amount till now

what is his source of income ? Did you give any document of his employment or assets in the DV case filed by you ? Did he file affidavit for statement of is Assets and liabilities ? What stage the 498A is nose ?

Dear client, From the facts, i came to conclusion that you are not divorced yet. You can apply for a divorce first and then get the custody of the child.
