28-May-2023 (In Divorce Law)
My child is 3 yrs old and the court has granted 3 day visitation in a week to his father. The father is very abusive towards me. Even during the ongoing case he is blatantly abusing me and my family during visitations both verbally and in mails. It's becoming very stressful for me to continue this way. I had even filed for modification but things didn't turn out much in favour. Does the law don't care about the primary caregiver and no relief can be expected? How do I stop visitations?

yes court does, do you have evidence that the father is abusive towards, if you can show court that your husband is abusive then only you can get the visitation stopped courts want proof without proof no one will trust you

you are the primary caregiver which is why you have the exclusive custody of the child at the first place. the father who in law is the natural guardian of the child has been restricted to have 3 visitation per week. however if you can make out a case of the father acting de hors the best interest of the child and is misusing the visitation right then the courts will further curtail such visitation right of the father. even if it has not gone in your favour you can always challenge that order before the high court under it's revisional jurisdiction. but first get your case documents vetted by some good lawyer before leaping for the next legal recourse. thanks & regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.
