if your brother in law has received Notice from high court he cannot remarry now. the law is that some one who has obtained a divorce decrea can remarry 3 months after such decree is granted. There is an exception to divorce decree obtained by fraudulent ways.

if the delay is condoned and the judgements and order of the trial court is stayed you cannot marry. otherwise you can marry no issue at all. if the trial court order is stayed , you cannot marry after disposal of the case you can marry.
