Mutual Divorce for a Muslim Couple

13-Oct-2023 (In Divorce Law)
Please let us know what is the procedure for getting a mutual divorce, legally valid for a Muslim couple. We have been married a little over 1 year & my husband is going abroad. So we want to complete the divorce procedure as soon as possible as we don't know when he will be back. Also, do we need to divulge reasons for this decision? What will be the expenses for this entire procedure? I want to spend as little as possible because of my financial position, I have not been supported by my husband in any way for a year. Thanks in advance.

I have perused the contents of your query. In Islamic divorce procedure through mutual consent, there are two ways to get divorced or dissolve the marriage. One is the “Khula” divorce and the other is “Mubarat” divorce form. In both these ways, wife agrees to let go of her dower or some part of any other property. In a case of mutual consent divorce in muslim law the wife needs to pay some amount of the compensation for dissolving the marriage and getting separated. Under this method of getting divorce in a Muslim Law, wife agrees to give the consideration to the husband about her separation from the marriage union. Leaving the husband from making the payment of Mahr to the wife is also one kind of a consideration. For the same you may contact us.

The mutual divorce will be filed under the muslim law and there will be two motions for the mutual divorce between the period of 6 months. The fee structure and the rest of the proceeding related queries can be discussed over a call or a legal meeting
