Mutual Divorce - Family Court Mumbai

01-Apr-2025 (In Divorce Law)
I got my divorce on February 24; 2025. I'm waiting for my judgment copy and divorce decree. Since the family court in Mumbai is overloaded there is a delay in getting these on time. My lawyer is following up to get these from court as soon as possible. Since we are waiting for the documents can the other party in this case my ex-spouse can appeal to the court and get the divorce cancelled.

Yes, there is every possibility that your ex-spouse might challenge the said decree in the appellate Court. But obtaining a certified copy of the decree won't be a hindrance and vice versa. Feel free to contact me for seeking any legal advice as regards the same.

Once the divorce judgment has been passed, the other party cannot “cancel” the divorce on their own. They may have the option to file an appeal, but only within a limited period and on valid legal grounds (such as fraud or serious error), which is rare in mutual consent divorces. Delay in receiving the decree copy does not affect the legal validity of your divorce. Since your lawyer is already following up, you are on the right track. If needed, we can also assist in expediting the decree or advising you on any defensive steps in case the other party attempts an appeal.
