You can apply for mutual divorce or a contested divorce only after one year from the date of your marriage. But if the behaviour of the partner is intolerable then you can always file for a judicial separation before the family court according to your jurisdiction. For more legal assistance I am just a call away.

It can be obtained from the family court of competent jurisdiction by moving an application duly signed by both parties. However, it is to be proven before the said court that they have been living separately for more than one year and have not been able to live together, and their marriage should be dissolved. Only after six months from the date of presentation of the above application court shall grant the decree of divorce.
