Sir,
My self & husband has filed mutual divorce petition in Nov-2017. mutual settlement was husband will take custody of girl child & i will not demand maintenance charge from him but unfortunately vice versa petition has been filed & husband refuses both things(Nor he will take girl child custody & nor will give monthly expenses for child).I am hindu & now case has been dismissed by court.he had not attended any hearing & refuses to give monthly expenses for child due financial condition
u can file divorce under cruelty ground and get the monthly maintenance for the child and yourself too if you are not working and if you are working then u will get maintenance for the child for sure it to be filed fresh but not mutual but under cruelty ground

Hello your query has been seen and understand in this case you can send him a legal notice and for divorce if you want else you can file divorce case against him before the honble family court but that will be not as mutual consent divorce
