I guess you are married under special marriage act. You could file divorce on the ground of cruelty and ask for maintenance for you and your children. Before deciding to file divorce petition try to work out your marriage by approaching qualified marriage counsellor to sort out your issues.

You have two remedies. For immediate relief ,file Petition under section 12 of Protection of woman from Domestic Violence,2005 along with interim orders of maintenance, protection order against husband , resident order for separate residence as husband is very cruel and torturing and threatening to life of the petitioner. Court will give exparte interim maintenance and other immediate relief.
Another remedy is for filing petition for Divorce under Section 27(d) of Special marriage act , read with section 18,19, 20 and 22 of Protection of woman from Domestc violence act
And can get adequate immediate relief for herself and for her daughter.

First you have to decide whether you want to live with him or no. If you decide to divorce him, then you can file for divorce, for your maintenance and for the child's maintenance. Also you can file cases under Domestic Violence Act and for cruelty. Also if you go for cases, who will support you and how you will pay for the legal fees and expenses involved.
