In Matter of Divorce Law - Second Marriage by Husband during subsistence of first marriage
Respected Madam,
As per your query, your husband has committed a very serious legal wrong.
1. SECOND MARRIAGE IS ILLEGAL:
Under Section 5(i) and Section 11 of Hindu Marriage Act, 1955, second marriage during the lifetime of first wife and without divorce is null and void. It is also a criminal offence under Section 494 IPC (Now Section 82 of BNS, 2023) which provides punishment up to 7 years.
2. GROUND FOR DIVORCE:
You have a very strong ground for divorce under Section 13(1)(i) (adultery) and 13(1)(ia) (cruelty) of Hindu Marriage Act. You can file a divorce petition before the Family Court.
3. MAINTENANCE:
You are entitled to get maintenance for yourself and your child. You can file a case under:
a) Section 125 Cr.P.C. (Now Section 144 BNSS) for maintenance.
b) Section 12 of Protection of Women from Domestic Violence Act, 2005 for maintenance

Since bigamy- marrying again while the first spouse is alive without legal divorce- is illegal. Your husband's second marriage is null and void under personal laws such as, Hindu Marriage Act, 1955. You may file a criminal complaint under Section 82 BNS (earlier Section 497 IPC) which carries a punishment of upto 7 years of imprisonment. As legally wedded wife you are entitled to monthly Maintenance from your husband under Section 144 of BNSS (earlier Section 125 Cr.P.C.). Your husband is legally obligated to provide financial assistance and cover expenses of your child. For custody of child file petition under Guardian and Wards Act, 1890. You have to 1. gather evidence and proof of your marriage. 2. gather evidence of child's paternity/birth. 3. gather evidence of your husband's second marriage 4. gather financial information of your husband's income. 5. file an urgent application for interim Maintenance under Section 144 BNSS / DV Act to receive some financial support in contesting cases.
