Move my RCR case from Bangalore to Mumbai

28-Jul-2023 (In Divorce Law)
Hi, my wife filed for divorce in Bangalore family court and I have filed an RCR in the same court. The proceedings are ongoing for past few months. Can I move my RCR case to my hometown Mumbai court as I am tired of going to Bangalore for these hearings? Whats the process? Can someone respond so I can take a consultation.

Transfer of cases relating to Matrimonial Disputes from a court situated in a particular state to a court situated in another state, can only be done by the way of ‘Transfer Petition’ which may be filed by either party to the case before the Supreme Court of India.

The procedure for transfer of case from one state to another happens through Transfer petition filed in Supreme Court of India. RCR case which you want to transfer to Mumbai is filed by you and not the other party so Court will not allow it to be transferred.

You can definitely try to do so, but it won’t be successful as the law recognises the convenience of women over men. For the above stated purpose, you will have to approach the hon’ble supreme court and file an SLP.

Well, you can get your Divorce case transferred to Mumbai by filing a Transfer Petition in the Supreme Court of India or else, you can also attend in your Divorce Proceedings going on in Bangalore through Video Conferencing facility.
