Mother can have 7 year old boy custody

We are planning for mutual divorce but my husband is not ready to leave my child . After divorce my only hope is my child .. Can i get my child custody , if I get divorce? I don't want his property /settlement money.. I just need my kid alone.. Please help how to get my kid custody..

If there is any unsolved issue between you and your husband then the process towards divorce by mutual consent will not materialize. Normally the custody of the child is with the mother. But only in a few cases child will be with the father. If the child is already with you then no need to worry. Welfare of the child is the primary thing.

Mutual consent divorce is different from child Custody. you have to file contested divorce to get the child Custody. if you are not filed for contested divorce it is not possible to get the child Custody. without separation nothing can be decided
