27-Sep-2023 (In Divorce Law)
I am paying month on month alimony Rs. 6000 (as per order) to other party (wife). Recent she has sent me court summons (Sec 125(3), 128) that last six months I've not paid and demanding last six months payments. I have bank statement in which all payment entries are there. Pls suggest in this situation what should I do.

appear before the concerned magistrate and place your case on the basis of the documents in your possession to dispute her claims of non payment and if those are genuine then the application of your wife fails. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.

there are very few ways in which you can save yourself from paying maintenance in its entirity but if you have the bank statements print them out and submit it in court over petition for mislead the court and wasting time and haul her up for lying on oath amounting to penalisation, there is a specific provision

Appear in the court and tell the judge through an advocate that you are paying alimony. if you are paying then she had instituted false case. You must appear before the court without fail. Otherwise court may pass adverse order exparte that will go against you.

sir, u accepted the fact that u have not paid for the last six months, I need to know the status of your case but a warrant may be issued in your name. but you have received the court summons recently then you have some time in your hand. proper homework and detailed discussion are necessary.
