Mental torture by in laws & husband (religion Hindu)

06-Nov-2023 (In Divorce Law)
My parents live in Meerut, U.P. & I was married to a business family in Ghaziabad in July 2009. I have two kids, 9 yr daughter & 6 yr son. My husband is a property dealer, very agressive & have links with criminal nature people. & started harassing me after some time of marriage. I am working in a multinational company & my income is more than my husband. In June 2007 my father had to give a cheque of Rs.10 Lakh to my husband under pressure for construction of house. one night my husband beat me & I had to file a police complaint & my husband give in writing that he will not beat me again. But he continue torturing me. Now I am living with my parents for the last 8-10 months but my husband forcefully took the kids with him 3 months ago & allowing me to meet them only on Sat & Sunday. My kids are very upset & start crying when they meet me. Pl suggest what step I should take for custody of my kids and return of Rs.10 Lakh to my father.

We can file petition for child custody mentioning the current situation and for the better growth of children. Further I would advise you to file Domestic Violence Case against your husband and Complaint before women cell under section 498A of IPC.

Hi

Based on your facts, it is clear that marriage is broken between, you two.

Also the custody of kids are taken in an illegal manner.

However going further, you need to file for

Divorce
Maintenance
Alimony
Custody

Incase you don't want divorce then ask for custody first. For more, you nay contact me
