In case of mutual separation(with/without divorce), while both Husband and wife are working, is there a legal binding for husband to provide financial support to the wife on regular basis or is it purely based on mutual consent ?

Till the date wife is silent as per mutual consent and staying separate, there is no binding for husband to give any financial support is valid. But Once she will file case for maintenance then it will be decided by court considering all relevant facts of particular case. If wife is working then also wife can seek maintenance and it will be decided by court considering many facts. But if she is earning well and educated enough to earn then Coury will consider all fact and decide No Maintenance as well.

Dear Sir, If you do not agree for alimony that is financial support in lumpsum to your wife then you may not get divorce in your lifetime. Better agree to pay some alimony and if interested get rid of present marriage bonds and start your new life or atleast be in peace.

hi, regarding mutual divorce case first both the husband and wife should decide about everything including maintenance, if husband is ok to pay then wife if she wish she can recv, she can also ask and if required negotiations can be done, but still both should decide on maintenance, child custody etc.... for more information. pls feel free to contact me. thanks
