Marriage took place in a pressurized situation and want a divorce.

A marriage took place in a situation where the person was not sure about the marriage and under family pressure and confusion the person agreed to marriage and got registered for marriage. But, the person is not happy with marriage because she loves another person and want to get married to that person. It's been 3 months the marriage took place and the person wants to get divorce but the person fears if her family doesn't allow her to do so. So, please help me to through legal advices please.

The best way out of this situation is to file for mutual consent divorce, if marriage is registered under the special marriage act then it is easier. read section 29 of the special marriage act. for more information provide more details regarding the situation so a proper solution can be determined.

Firstly if the one of the party is not ready to continue the marriage she needs to leave the matrimonial house and stay separately. secondly if both the parties are willing to get the marriage dissolved they can do it by filing a mutual consent petition. however petition for divorce can only be filed in the court only after the lapse one year from the date of marriage.

The person can apply to court for annulment of marriage on the grounds of forcefully obtained consent for marriage. It will be much easier than going for divorce as the consent for marriage was obtained by force and confusion.
