Marriage is not registered, Staying separate now Divorce with consent

19-Jun-2023 (In Divorce Law)
Our marriage was as per the Hindu rituals, however we never got the marriage registration done. We stayed together for two years and due to personal differences later we were staying separately. It’s more than a year we are staying separate. Do need to file for a divorce? If yes, what will be the process and how much time will it take? It is a mutual consent.

Hello you can file divorce by mutual consent under Hindu Marriage act documents for proof of marriage like marriage photo, marriage card etc are required, marriage registration is not compulsory. Process is of two hearings in court first motion and second motion at interval of six months. Usually it takes six months time to obtain decree of divorce but this period can be cooled of in certain cases but depends upon the circumstances of each case.
