Maintenance while living separately.

25-May-2023 (In Divorce Law)
I have been married little over 2 years. My marriage has been abusive and toxic with little to none financial support from my husband. He is a high ranking Indian army officer. On his condition, I left a good earning job to accompany him on his postings. He and his family have been cruel to me. He is a drug abuser who would get violent to me and the mental harassment was so bad that now I have to seek therapy because I m so broken. I have left him(with almost all my stuff still in his possession). I have to get therapy for my chronic depression and m not earning anything as of now. Can I claim maintenance and my medical expenditure without filling for divorce?

Yes…you can always file your complaint against your husband and your in-laws under domestic violence act and claim your monthly maintenance and the lump sum expenses you have incurred so far. And if the behaviour of your husband is intolerable towards you then you can always file for divorce. For more legal assistance I am just a call away.

Going by the limited information provided by you, I understand that you want to have maintenance without asking for divorce. The same is possible under Section 125 of Crpc Act whereby you can ask for maintenance being his wife.

for claiming maintenance you will have to file a petition under Section 125 CrPc. i would like to suggest that in case you want to add extra pressure on the opposite party you can also go for filing a divorce petition on the ground of cruelty in the concerned court and proceed further with that as well. explore both the options. for further queries please feel free to contact
