Maintenance Rules And Registration Of FIR Against False Complaint

Hi All, Returned all stridhan articles at caw cell Delhi with due acknowledgement obtained and paragraph wise response has been submitted at ACP CAW Cell and DCP office against false complaint. Mediation and counselling has failed. What is the next step now. Is it mandatory that fir will be filed or they may not file it after seeing the response and evidence and then court can got case directly without fir, how does that work

If you are cooperating enough to help in obtaining the evidences and the police officials are satisfied that you are wrongly charged with the offence and it was fake complaint then the police might not register a FIR. But the other party can approach the court u/s 156(3). For more legal assistance I am just a call away.

hello client as a matter of facts which you have mentioned above in this matter the FIR is confirmed now to get regstered at present condition . in this matter you need not to worry we can still save you self but for tht we need to move to court now itself.

The department may be compelled to register the FIR against the person who has been summoned by the CAW on the complaint of the woman. This is the last step the CAW may take when there is no harmony and settlement between the parties concerned. You must have to take recourse to the concerned court of the competent jurisdiction for relief and it may be HC for quashing of the FIR.

If u have returned the articles u are only saved from 406ipc and not 498a or Dowry or DV etc Police will lodged FIR on the contentions on other ingredients of complaint ! U need to hire expert advocate Plz b in touch Take care
